These Terms and Conditions for providing access to the online platform “TV Days Digital” of the Serial Killer festival (hereinafter referred to as the “Terms and Conditions”) govern the mutual rights and obligations between the organizer of the Serial Killer festival – Telepunk s.r.o. company, with its registered office at Sukova 49/4, Brno-město, 602 00 Brno, company registration number 05508746, tax identification number CZ05508746, registered at the Regional Court in Brno, Section C, Insert 95796 (hereinafter referred to as the “Organizer”) and a natural person who registers via the form that can be found on the Organizer’s website available at www.serialkiller.tv in the “TV Days Digital” section and subsequently (a) purchases here the access to this section, thereby concluding a purchase agreement (hereinafter referred to as the “Buyer or Customer”) or (b) inserts a voucher code that will allow her/him access to the section free of charge (hereinafter referred to as the “Customer”).
The provisions of the Terms and Conditions are an integral part of the agreement on the provision of access to “TV Days Digital” (hereinafter referred to as the “Agreement”). Deviating provisions in the agreement take precedence over the provisions of these Terms and Conditions. These Terms and Conditions and the agreement are entered into in the Czech or English language.
Information about the service, including the price for the service and its main features, is given in the “TV Days Digital” section. Some information may only be available after registration. The price for the service is stated including the value added tax and all related fees. The price of the service remains valid as long as it is displayed on the website. This provision does not preclude the negotiation of an agreement under individually agreed conditions.
Access is guaranteed for 3 months after gaining access to TV Days Digital.
The buyer can pay the price for the service by cashless card payment through a payment gateway.
In the event that there is an obvious technical error on the part of the organizer when stating the price of the service or during the ordering, the organizer is not obliged to deliver the service to the buyer for this completely obviously incorrect price. The organizer informs the buyer about the error without undue delay and sends an amended offer to the buyer to her/his e-mail address.
Access to the “TV Days Digital” section can be obtained after registration either (a) on the basis of paying the purchase price through the payment gateway or (b) by entering the voucher code, which the organizer may provide at his own discretion. There is no legal entitlement to obtain the voucher code.
After filling out and sending the form, it is necessary to confirm the e-mail address by clicking on the link sent in the e-mail message to complete the registration. After confirming the e-mail, the user account will become accessible to the customer, where she/he will able to purchase the access or enter the code.
Based on the registration, the customer is entitled to access her/his customer account. When registering for a customer account, the customer is obliged to state all data correctly and truthfully. The data stated by the customer during the registration are considered correct by the organizer.
Access to the customer account is secured by a username and a password. The customer is obliged to maintain confidentiality of the information necessary to access her/his customer account. The organizer is not responsible for any possible misuse of the customer account by third parties.
The customer is not entitled to allow the use of the customer account to third parties. The organizer may cancel the user account, especially in case the customer breaches its obligations under the agreement and these terms and conditions.
The customer acknowledges that the customer account may not be available around the clock, especially with regard to the necessary maintenance of the hardware and software equipment of the organizer, or the necessary maintenance of the hardware and software equipment of third parties.

The buyer acknowledges that from the moment of the payment of the purchase price, the digital content will be made available to her/him, whereby the buyer loses the right to withdraw from the agreement.
The buyer is entitled to a refund of the purchase price only if the service will be unavailable for a long time (i.e. several consecutive days) or the provision of the service will be terminated prematurely. The organizer is not responsible for the unavailability of the service due to the fault of the buyer (e.g. loss of login data, use of unsupported equipment) or the unavailability of the internet connection.
The buyer can claim the refund of the purchase price at the organizer’s registered office or by e-mail at info@serialkiller.tv.
In case a consumer dispute arises between us and the consumer from the purchase agreement or the agreement about the provision of services, which cannot be resolved by mutual agreement, the consumer may file a proposal for out-of-court settlement of such dispute to a designated entity of out-of-court settlement of consumer disputes, that is the Czech Trade Inspection Authority, Central Inspectorate – ADR Department, Štěpánská 15, 120 00 Prague 2, e-mail: adr@coi.cz, website: http://www.adr.coi.cz.
The consumer can also use the online dispute resolution platform set up by the European Commission at http://ec.europa.eu/consumers/odr/.
All agreements between the organizer and the customer are governed by the laws of the Czech Republic. If the relationship established by the agreement contains an international element, then the parties agree that the relationship is governed by the law of the Czech Republic. This does not affect the consumer’s rights arising from generally binding legal regulations.
All rights to the organizer’s website, in particular the copyright to the content, including the page layout, photos, videos, graphics, trademarks, logo and other content and elements, belong to the organizer. It is forbidden to copy, modify or otherwise use the website or parts of it without the consent of the organizer. It is also forbidden to copy, publish, download or distribute the recorded videos or record them in any way.
The organizer is not responsible for errors caused by third party interventions in the TV Days Digital platform or as a result of its use contrary to its purpose. When using the platform, the Customer may not use procedures that could have a negative influence on its operation and may not engage in any activity that may allow her/him or third parties to tamper with or to use the software equipment or other components that constitute the TV Days Digital platform unlawfully and to use it or its parts or the software equipment in such a way that would be contrary to its function or purpose.
The organizer reserves the right to change these terms and conditions at any time. This provision does not affect the rights and obligations arising during the period of validity of the previous version of the terms and conditions.
These terms and conditions take effect on December 16, 2021.
